On August 3, 2015, the Honorable Frank Whitney conducted the sentencing hearing in the criminal case against James H. Mason. Although a written order is forthcoming, the Court ruled from the bench during the hearing that Mason was sentenced to 96 months’ imprisonment, the maximum sentence allowed by law for the charges to which Mason pleaded guilty. The Receiver will republish the sentencing order on this website and circulate it via email once it has been entered by the Court.

On May 13, 2015, the Honorable Frank Whitney scheduled a hearing in the criminal case against James H. Mason to determine the appropriate sentence for Mason’s crimes. The sentencing hearing will be held at 3:00 p.m. on May 20, 2015 in Courtroom 1 on the second floor of the United States Courthouse located at 401 W. Trade Street, Charlotte, North Carolina. The hearing is open to the public.

Receiver Recovers $220,000.00 from Gallaghers

Pursuant to prior Orders of the Court approving a settlement agreed to by the Receiver and Steve and Lynn Gallagher, the largest “net winners” in Mason’s Ponzi Scheme, the Gallaghers have transferred the full settlement payment, $220,000.00, to the Receiver. CLAIMS PROCESS APPROVED BY COURT; CLAIM FORMS DUE OCTOBER 20, 2014

On September 2, 2014, the U.S. District Court entered the attached Order approving the Receiver’s proposed process for establishing investors’ claims against the Mason Receivership Estate. As the attached Notice sets forth in greater detail, investors should complete the attached Claim Verification Form, attach all required documentation (if any), sign and return it as instructed on the last page of the Claims Verification Form on or before October 20, 2014. You do not need to file your claim with the Court.

If you have already sent an executed Claim Verification Form to the Receiver, you do not need to do so again. Claim Verification Forms received by the Receiver prior to Court approval shall be deemed properly-filed claims.

After October 20, 2014, the Receiver will review each Claim Verification Form and accompanying documentation and then file with the Court a final recommendation as to the treatment of all claims, including a narrative explanation of any objections to submitted claims (the “Claims Report”). Each investor will have the opportunity to object to all or any portion of the Claims Report.
