Proposed Settlement with Joey Barnhill

On March 9, 2015, Joseph W. Grier, III, Receiver, filed a motion to approve a settlement of the Receiver’s claims against Joseph M. Barnhill, Jr., upon the terms and conditions more particularly described in the motion. Most basically, the settlement provides that, in exchange for dismissing the lawsuit filed against Barnhill, the Receiver will receive a lien on Barnhill’s real property securing Barnhill’s payment of 80% to 100% of his net winnings (or $18,000 to $22,500). If Barnhill does not pay the Receiver by August 1, 2015, then the Receiver can foreclose on the subject real property.

If you do not want the Court to approve this motion, or if you want the Court to consider your views, then on or before March 27, 2015, you or your attorney must do the following: (1) file a written response explaining your position with the Court; (2) mail, fax or email a copy of your response to the Receiver; and (3) attend a hearing on your response, if the Court schedules a hearing.

If you or your attorney do not take these steps, the Court may decide that you do not oppose the relief the Receiver requests and may enter an order approving the motion to approve the settlement with Barnhill.

    Isn’t it over yet? $20k recovery will be less than your 1 month fee. What’s the clawback all about, just money transfer from the net winner to you? What’s the hell of August deadline? How long will you devour our money? Someone is right, you are the only winner. Finish & pay us back quickly.
