Court Establishes December 1, 2014 as the Deadline to Submit Secured Claims

On October 22, 2014, the Court established December 1, 2014 as the deadline for those asserting claims against the receivership estate to assert an enforceable security interest in, or other priority in payment from, the assets of the receivership estate. Pursuant to the terms of the Order linked below, in order for a claimant to assert an allowable security interest or other priority in payment, the claimant must: (1) file a pleading with the Court no later than December 1, 2014; (2) describe with specificity the receivership estate assets from which the claimant asserts a priority in payment; and (3) attach copies of any and all documents demonstrating the security interest or otherwise supporting the claim for a priority in payment.

Any party’s failure to file a pleading meeting the requirements set forth in the Order shall result in such party’s claim, to the extent the claim is an allowed claim, being treated as a general unsecured claim against the receivership estate assets payable pursuant to the Order Approving Distribution Method and Distribution Procedure entered on October 14, 2014.
